Version 2.0 · Effective October 15, 2026
These Terms explain your subscription, your choices about agent access, and your rights and responsibilities when using HeyMOE. They are between you and Hey Moe, LLC, doing business as HeyMOE, a Wisconsin limited liability company. “Services” means our website and HeyMOE software made available through it or an application.
By accepting these Terms when creating an account or purchasing a subscription, you agree to them. The Privacy Policy and Consumer Health Data Privacy Policy explain how we handle information and are part of these Terms, subject to applicable law. Their privacy protections and specific consent limits are not reduced by general terms. Neither acceptance nor use of a referral link or code gives an agent permission to view your medications or results. That requires the separate choice described in Section 6.
If you participate as an affiliate, the Affiliate Agreement controls your referral relationship, including attribution, payments, promotions, and affiliate responsibilities, whether or not you use a dashboard. These Terms govern your own subscription. Specific consent limits control optional agent access. No document or later change may reduce the existing referred-client protections described in Section 7.
HeyMOE helps you research and compare Medicare Part D prescription drug plans using information you provide and data from government and other outside sources. Our service is educational. We do not sell insurance, enroll you in a plan, or transmit an enrollment application. Medicare has neither reviewed nor endorsed HeyMOE.
Your plan choice is yours. Results depend on your medications, pharmacies, location, and the available plan data. Prices, formularies, coverage, and availability can change. Results are one factor in your decision; confirm plan details with the plan or Medicare before enrolling. HeyMOE does not provide legal, financial, investment, medical, insurance, or tax advice.
The Services are intended for adults in the United States who can enter a binding agreement. Anyone helping you create or set up your account must have your permission. That assistance does not give them ongoing access to your medications or results. Optional access requires your separate, explicit consent through HeyMOE’s access process. Assistance does not transfer your account or permit an affiliate to consent to access on your behalf.
Provide accurate information and keep your contact details current. Protect your login credentials, use the access tools we provide instead of sharing credentials, and notify support@heymoe.com if you suspect unauthorized access. Review the medications, pharmacies, and other information used in your comparison and correct errors you find.
Account creation fixes referral attribution to the link or code used at signup. Later links, cancellation, return to the same account, or a change of insurance agent do not switch the referral. We may correct documented errors or fraud. Referral attribution and permission to view health information are separate.
The price, subscription period, applicable discounts, and renewal terms are disclosed when you purchase. Our standard subscription covers one year. Taxes may apply. Discounts apply only as stated at purchase; a first-year discount does not promise the same discount on renewal.
If your checkout provides for automatic renewal and you authorize it, we charge your authorized payment method for each renewal until you cancel. We disclose the recurring charge and cancellation method before obtaining that authorization. Otherwise, another purchase requires your authorization. We provide renewal and price-change notices as required by law. A new price applies to a future renewal after the required notice, not to the period already paid for.
If a renewal payment is not completed, we may suspend access to the unpaid period until payment is resolved. A failed renewal does not shorten a subscription period already paid for. We do not promise a fixed payment-retry or grace period in these Terms.
You may cancel future renewals through the subscription controls in your account or by contacting support@heymoe.com. Cancellation stops future renewal charges. Your access continues until the end of the subscription period you have paid for, unless you receive a refund ending that period or access is suspended for a reason permitted by Section 10.
You may request a full refund of an initial subscription payment or renewal payment within 30 days after that payment, provided the first set of plan-comparison results covered by it has not yet been made available to you. The refund window ends when those results become available or 30 days after payment, whichever occurs first.
For refund purposes, the first set of comparison results made available under a payment counts as delivery of the service covered by that payment, even if the payment also covers additional comparisons. After the refund window closes, the payment is nonrefundable except as provided in Section 10 if HeyMOE ends your paid access or discontinues the Services, or where law requires a refund. Whether you open or read the results does not change this rule. Results covered by an earlier payment do not end refund eligibility for a new payment. If you cancel future renewals, your access continues as described above.
The same refund policy applies to subscribers who used an affiliate link or code. We do not deduct an affiliate's referral payment from a full refund owed to you. To request a refund or report an incorrect charge, contact support@heymoe.com with enough information to identify your account and payment. Nothing here limits legally required refunds or other rights that cannot be waived.
When you create an account using an affiliate's link or code, the referring person or organization can receive your name, email address, account-creation date, subscription-start date, and latest renewal date to track referrals and payments. We also notify your referring affiliate by email when you complete signup using their link or code. The referrer may receive a payment for eligible subscriptions and renewals; an associated umbrella organization may receive an additional payment. Referral status alone never gives either access to your medications, pharmacies, or comparison results. If sharing your referral information requires separate consent, we obtain it before sharing. Accepting these Terms does not provide that consent.
Through available features, you may separately approve an identified licensed insurance agent or broker, or another type of professional HeyMOE has approved for client access, connected with your referring affiliate to view the health information described in the Agent Access consent. The consent identifies the agent and company and explains the information and purpose before you agree. Access is voluntary and view-only; the agent cannot edit your account through that permission.
Depending on the consent's stated scope, the information includes prescription names, dosages and quantities, pharmacy preferences, Part D rankings, cost estimates, formulary information, and related analysis, notes, or flags. The permitted purpose is helping you understand your HeyMOE results. It does not permit marketing, profiling, onward sharing, or access by other agency or umbrella personnel.
You may refuse or revoke access without losing your HeyMOE service. In Agent Access settings, select Remove Agent Access to end access immediately. Revocation cannot undo information already viewed, but the agent's continuing confidentiality and use restrictions still apply. You may also contact support if you need help. Changing insurance agents does not transfer access or referral payments. An agent's loss of access does not cancel otherwise eligible referral earnings.
If your genuine account is attributed to a referral link or code, you are a Protected Client under Section 1 of the HeyMOE Affiliate Agreement, Version 4.2, effective October 15, 2026. That section gives you the right to enforce your own protections directly, even if the affiliate stops participating, dies, or closes. You do not need to join the affiliate program or submit a separate application. Protection begins at account creation, or when the protective agreement takes effect for an already attributed client, regardless of whether a referral payment has become eligible.
HeyMOE will not use your referral relationship, subscriber information, or access to market or sell the insurance products or enrollment services covered by that section, generate insurance leads, or divert you to an insurance business or competing advisor. We will not sell, rent, or license your information for another person's marketing, including targeted or profiling uses of deidentified or aggregated information. Basic referral records and separately authorized agent access do not permit broader marketing, enrollment, or sharing.
These protections last for your life, even if you cancel, return later, revoke access, or your affiliate leaves. They bind a successor if HeyMOE is sold and must be carried forward on later transfers. A buyer may change terms for future referrals but cannot reduce protections already attached to your account. Your death does not erase other duties concerning retained information or claims for earlier breaches.
The protections allow ordinary service operations, restricted service providers, legally required disclosures, and transfers to a bound successor. They do not prevent a buyer's independent client relationships or general advertising that does not use HeyMOE information to target you. Copying or routing HeyMOE information through another business does not make it independently obtained.
Section 1 of that identified Affiliate Agreement supplies the full scope of the protections and permitted uses. Section 15 of that agreement supplies the financial limitations and exceptions for enforcing those protections, with any referral-payment cap measured using your referring affiliate's payments. It permits you to ask a court to prevent or stop a violation; relief is decided by the court. The $100 limit and one-year claim deadline in Section 12 of these Terms do not add a second limit to that protection claim. Subscriber disputes, including your protection claim, follow Section 14 below rather than affiliate commercial arbitration. Your independent legal rights remain unaffected.
The Privacy Policy explains what information we collect, how we use and disclose it, and how to request access, correction, or deletion. We do not sell your personal information or provide your email to third parties for their marketing. Operational disclosures, basic referral information, and optional agent access are distinct and described there.
You retain your rights in your personal information. Giving HeyMOE information to provide the Services is not permission to sell it or use it in violation of the Privacy Policy, Section 7, or your consent. Cancelling a subscription is different from requesting deletion of an account. The Privacy Policy explains retention and deletion; retained information remains protected after cancellation.
We give you a limited, nonexclusive, nontransferable right to use the Services for personal Part D research and comparison. You may save or print your own results and share them with people you choose. This does not authorize an affiliate to redistribute health information obtained through Agent Access. Authorized affiliate activity remains governed by the Affiliate Agreement.
Do not scrape or bulk-download the Services, use unauthorized automated access, resell access, copy or distribute our software, reverse-engineer it except where law permits, remove ownership notices, or display it within an unauthorized frame or wrapper. Do not misuse our name or trademarks, evade security, introduce malware, violate another person's rights, or use the Services unlawfully or abusively. Rights under applicable open-source licenses are unaffected.
HeyMOE and its licensors retain ownership of the software, design, content, names, and marks. You receive only the permissions expressly granted here. If you provide product suggestions, you allow us to use them without payment or further permission. That permission does not override restrictions on your personal or health information.
We may add, remove, or change features and data sources. We do not promise a fixed interface, particular dashboard fields, or future sharing features. Changes do not remove existing client protections, earned affiliate payments, or consent requirements.
We may restrict or end access for misuse, unlawful conduct, a material violation, or a security risk. When practicable without increasing risk, we will notify you and allow correction. We may also discontinue the Services or end access for other reasons, subject to applicable law and Section 5. If we discontinue the Services or end your paid access before the first comparison covered by your payment has been made available, we will refund that payment in full. If the first comparison has already been made available, no refund is due solely because we end access or discontinue the Services, even if additional comparisons were included, except where law requires a refund. Refunds are not prorated by time remaining. Cancellation under Section 5 alone does not end paid access early.
Ending access does not erase refund rights, existing client protections, information-handling duties, or obligations and remedies intended to continue. The provisions about ownership, confidentiality, liability, disputes, and lasting protections continue as applicable.
The Services are provided “as is” and “as available.” To the extent law permits, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We cannot guarantee uninterrupted access, error-free results, complete or current outside data, or that a result identifies the best plan for your circumstances.
You are responsible for your decisions and for advice you give others based on your use of the Services. We are not responsible for independently provided advice or third-party websites. These qualifications do not excuse our own express obligations concerning refunds, privacy, consent, or client protections, or responsibility that law does not allow us to exclude.
To the extent law permits, HeyMOE is not liable for indirect, incidental, special, punitive, or consequential damages, or lost profits or data arising from the Services. Our aggregate liability to you is limited to $100. Claims under these Terms must be brought within one year after the claim arises, to the extent that deadline is enforceable.
These limits do not excuse refunds owed under Section 5, prevent a request for a court order, or limit liability that cannot legally be limited. Section 7 specifies the separate financial framework for a Protected Client enforcing those protections; this section does not override it. Affiliate payment and program claims follow the Affiliate Agreement. Mandatory legal rights and remedies remain available.
To the extent law permits, you will defend and indemnify HeyMOE for third-party claims and reasonable resulting costs, including attorney fees, caused by your unlawful use, violation of these Terms, or infringement of another person's rights. This does not make you responsible for losses caused by HeyMOE's own misconduct or for lawful exercise of your privacy, refund, or client-protection rights.
We will notify you promptly of such a claim and reasonably cooperate. A settlement cannot impose an admission or nonmonetary obligation on the other party without that party's consent.
Please contact support@heymoe.com to try to resolve a concern. This request does not delay your right to seek a court order to protect your information or enforce Section 7, or suspend a legal filing deadline.
Wisconsin law governs these Terms, without its conflict-of-law rules. To the extent permitted by law, subscriber lawsuits will be brought in courts located in Milwaukee County, Wisconsin, and you and HeyMOE consent to their jurisdiction. This does not take away mandatory protections or a legally required right to bring a claim elsewhere.
These Terms do not require subscriber arbitration or add a jury-trial or class-action waiver. The Affiliate Agreement's dispute provisions apply to affiliate-program claims made in an affiliate capacity. Merely using a referral link or code does not make you an affiliate. An affiliate's dispute about its own personal subscription is a subscriber dispute.
We may update these Terms by posting a revised version and effective date. We will give advance notice of material changes by email or another legally sufficient method and obtain further agreement when required. Changes do not retroactively alter accrued rights or the price for a period already paid for. Continued use after an effective change constitutes acceptance only to the extent permitted by law. Optional health-data sharing still requires its separate consent.
No update to these Terms, the Privacy Policy, the Affiliate Agreement, or another program document can reduce protections already attached to a Protected Client. A later version does not replace those protections with weaker terms.
HeyMOE may transfer these Terms and the business in a sale, merger, or reorganization without your separate approval. A successor receiving the business or your information must assume applicable information-handling commitments and existing Protected Client protections, including the obligation to pass them on in later transfers. Transfers remain subject to law and the Privacy Policy. You may not transfer your account or rights without our written permission.
These Terms, the Privacy Policy, and any applicable signed agreements describe our agreement about the Services, subject to the priority rules in Section 1. They do not replace existing Protected Client rights or reduce consent restrictions. Electronic signatures and recorded electronic acceptance may form a binding agreement. An unenforceable provision will be limited as necessary without invalidating the rest. Not enforcing a provision once does not waive it later.
